Terms

Article1 Applicability
1.1
These General Conditions apply to all offers of www.brand newage.nl and all in www.brand newage.nl contracted agreements.

1.2
Accepting an offer or placing an order means that the customer accepts the applicability of these General Terms.

www.brand-newage.nl reserves the right to modify these Terms or supplement.

1.4
By using the website www.brand-newage.nl and / or placing an order the customer accepts these Terms and any other rights and obligations as stated on the website.

Article 2 Offers and Contracts
2.1
All offers of www.brand-newage.nl are optional and while stocks last.

2.2
www.Brand-newage.nl reserves the right to change its prices and rates. The price change does not apply to current orders at the time of the increase.

 

2.3
An agreement is established when a confirmation of a purchase order by e-mail was sent to the email address provided bij the costumer. The client and www.brand-newage.nl expressly agree that use of electronic communication constitute a valid agreement when it comes to customer order confirmation is sent.

2.4
Descriptions of the items are as accurately as possible. www.brand-newage.nl does not guarantee that all offers and articles are exactly accurate. Deviations can not lead to compensation and / or dissolution.

Article 3 Prices and payments
3.1
All-www.brand newage.nl prices are denominated in Euros and include VAT. and without shipping and handling costs, unless otherwise stated.

3.2
The costs of the shipping and handling are stated on confirmation and are valid for shipping within the Netherlands.



3.3
Special offers are only valid for the duration as indicated on the website relating to this special offer.

3.4
Orders placed through the website can be paid in the following ways:

payment in advance, the customer makes a moneytransfer including shipping and handlingcosts on bank account number: 5823083

in the name of BRANDNEWAGE TILBURG, quoting the invoice number.

Payments through Ideal.

 

3.5

Payments must be paid within 14 days. When this is exceeded, the agreement will lapse and the amount will be refunded.

Article 4 Delivery and Shipping
4.1
www.brand-newage.nl has most items in stock. Orders will be delivered as soon as possible:

We send the ordered items usually within two working days after receiving payment. With a exceeding period  of 14 days.

The above delivery times are approximate. Exceeding of the delivery, the customer is not entitled to compensation or the right to cancel the order or the agreement, unless the delay in delivery is such that the customer can not reasonably be expected to maintain the customer agreement. The customer is then entitled to cancel the order or terminate the agreement if necessary. Any payments already made will be returned.

4.2
If an item is temporarily out of stock, the customer ordered, will be declared when the item is available. Delays will be communicated to the customer by email or by telephone.

4.3
Delivery takes place at the Buyer at the conclusion of the contract address.

4.4
The risk of loss or damage to the products applicable to the contract, transfer on to the customer at the moment products are legally and / or actually delivered and in the power of the customer or a customer to designate to a third party.

Article 5 Ownership
5.1
Ownership of products will only pass if the customer has met obligations stated under any contract with www.brand-newage.nl. The risk in respect of the products will be on when the products are provided  at the by customer specified delivery address .If the customer fails or refuses to receive the items, the resulting damages and costs will be for his / her account. Any returns to www.brand-newage.nl and the costs derived from returns are for the customer and must be reasoned in writing.

Article 6 Returning
6.1
If the products do not meet the agreement, you must inform us as soon as possible and in any case within 8 days after delivery, at least as soon as reasonably possible after observation, accompanied by writing and sufficient detail.

6.2
If it is proven that the products do not meet the agreement, www.brand-newage.nl selects relevant products to replace the products or to refund the invoice value.

6.4
Returns are to the customer's expense.

 
Article 7 Guarantee and Liability

 

7.1

www.Brand-newage.nl ensures that the delivered goods meet the usual requirements and standards that can be expected and are free of any defects. The above warranty is valid for a period of 8 days after delivery.

The user's invoice is used as evidence in relation to the guarantee.

 

7.2

If the delivered products do not meet these guarantees www.brand-newage.nl will replace products or arrange for recovery within a reasonable period following notification of the defect by the customer chooses www.brand-newage.nl. Returns sent without notification will not be processed. The costs for returns are at the customer's expense. In case of replacement, the client gives www.brand-newage.nl the ownership of the order.
 

7.3

The aforementioned warranty does not apply when the defect is caused by improper or inappropriate use or when, without written permission from www.brand-newage.nl, client, or others have made changes or tried to repair the product or have used the product for purposes not intended.

 

7.4
If the delivered good does not comply with the agreement and this non-conformity is a defect within the meaning of the regulation of the product, then www.brand-newage.nl is not liable for consequential damages.

 


Article 8 Force majeure
8.1
In case of force majeure www.brand-newage.nl has not kept its obligations to the customer, the obligation is suspended for the duration of the circumstances.

8.2
Force majeure includes any circumstance beyond its control, thus fulfilling its obligations to the Customer entirely or partially prevented. These circumstances include strikes, fires, business disturbances, power failures, non or late delivery by suppliers or other third parties and the absence of any government issued license. Also, the force majeure include failures in (telecommunications) networks or connections or communication systems and / or at any time faillure of the website.

Article 9 Personal
9.1
The data provided by the customer, by www.brand newage.nl is confidential and will only be used to process the order, payment and delivery at the correct address.

9.2
www.brand-newage.nl will observe the applicable privacy regulations and legislation.

9.3
www.brand-newage.nl will not provide customer information to third parties.

Article 10 Applicable law and jurisdiction
10.1
All rights, obligations, offers, orders and agreements to which these Conditions apply only Dutch law. including these Terms.

10.2
All disputes between parties will be submitted to the competent court in the Netherlands.

Article 11 Provider
11.1
www.brand-newage.nl is registered at the Chamber of Commerce Brabant under number 17265043.

 

Applicable is the last placed www.brand-newage.nl version or the version valid at the time of the conclusion of the agreement.
